The tempering valve is the least glamorous fitting on your hot water system and one of the most important, because it resolves a genuine conflict: water hot enough to be safe from bacteria is hot enough to scald a child in about a second. Here is what the valve does, what the rules require, and how to tell where your home stands.

Why can't I just turn the tank down to 50 degrees?
Because a tank stored below 60 degrees is a breeding environment for Legionella, the bacteria behind Legionnaires' disease, which multiplies happily in warm stagnant water. That is why the standard demands both numbers at once: 60 or above in storage, 50 or below at the bathroom tap, and the tempering valve is the device that makes both true simultaneously. Turning the thermostat down to save energy or soften shower temperature defeats the safety logic in the wrong direction, and it is one of the first things we check when a customer mentions lukewarm water and a smelly tank. Thermostat and valve adjustments on a hot water system are licensed work in Queensland, so if your delivery temperature feels wrong at the taps, have it measured and set properly rather than guessing at the tank dial.
Does my house legally need a tempering valve?
If your hot water system was installed or replaced since tempering requirements came into force, yes, it should already have one, and every new install and replacement we do on the Gold Coast includes one as a matter of compliance under AS/NZS 3500.4 within the Plumbing and Drainage Act 2018 framework. The grey zone is older homes. A system installed decades ago was not required to be retrofitted overnight, so plenty of original installs are still delivering full tank temperature to the bathroom. That is legal inertia, not safety. The moment the system is replaced, the new install must comply, which is one reason a like-for-like swap quote includes more than the tank itself. Our practical position: if children or elderly family use your bathrooms and your hot taps run scalding, do not wait for the tank to die before fixing the delivery temperature.
How do I know if I already have one?
Look at the pipework beside the hot water unit. A tempering valve is a small brass fitting, usually with a coloured cap, where the hot outlet and a cold line meet before heading into the house. If you see only a single hot line leaving the tank with nothing teed into it, you likely have no valve. The functional test is simpler: run the bathroom basin hot tap and measure the water with a thermometer once it stabilises. Around 50 degrees suggests a working valve. Well above that, painful within a second or two, means no valve or a failed one. Tempering valves are wear items, typically good for 5 to 8 years before the internal element drifts, and a valve that has failed can drift hot or cold, which is why hot water that has gradually become cooler at every tap is sometimes a tempering valve fault rather than a tank problem.
What does fitting or replacing one involve?
It is a small, quick job for a licensed plumber: isolate the system, cut the valve into the hot delivery line with a cold feed, set the delivery temperature with a thermometer at the furthest fixture, and record it. What you should not do is attempt it unlicensed: this is regulated plumbing work in Queensland, the setting matters as much as the fitting, and a wrongly set valve either scalds someone or quietly serves your bathrooms lukewarm water all winter.
